These General Conditions govern the sale of the products presented on this WEB by Basqueland Brewing Company S.L. With address at Akarregi Ind., 4B, 20120 Hernani, Gipuzkoa (Spain) and tax identification number B75086942. Registered in the Mercantile Registry of the province of Guipúzcoa in Volume 31983, folio 63, sheet B-203162, inscription 4.
All purchases made on this WEB are subject to the following General Conditions and Law 7/1998, of April 13 on General Conditions of Contract. These sales are regulated by Law 34/2002 of July 11, on Services of the Information Society and Electronic Commerce.
Prices quoted on the website include taxes.
2. DELIVERY TIMES
The delivery times only compute hours on working days and these can be altered for the holidays. The delivery service of Basqueland Brewing Project, is carried out in collaboration with different logistics operators of recognized prestige.
3. SHIPPING COSTS
The cost of the shipments is not included in the price of the products.
Shipping in peninsula:
• For orders higher than or equal to € 100, taxes included, shipping costs will be free.
• For orders higher than or equal to € 48, taxes included, shipping costs will be € 4 + VAT.
• For orders lower than € 48, taxes included, shipping costs will be € 8 + VAT.
Shipping to Balearic Islands:
• No shipments are made.
Shipments to Ceuta, Melilla, Canary Islands and foreign countries:
• No shipments are made.
4. RETURNS AND EXPENSES
• Goods deteriorated during transport.
Because of the quality controls that Basqueland Brewing Project has in place, the items come out in perfect factory condition. If the goods are damaged or broken due to improper handling of the carrier, the transport agency will have to be responsible, prior communication to the carrier itself through the delivery note (in a visible place) and directly to Basqueland Brewing Project Through the email email@example.com.
This communication must be processed within 24 hours after receipt of the merchandise.
• Products that are expired and / or unfit for sale by defective products.
Refunds of expired items are not accepted unless at the moment of receipt of the product, it does not have a minimum of 3 months expiration.
In our factory there is a quality control and it is monitored and the expiration of all the products is recorded so that Basqueland Brewing Project fulfills the condition of expiry mentioned above.
• Items sent by factory error.
Please notify us immediately at firstname.lastname@example.org and as soon as possible, we will organize the re-expedition to the Basque Brewing Project factory with the interest of eliminating the incidence of the documentary circuit as soon as possible.
• NOTE: Returns that do not meet these conditions will not be accepted.
Shipments that are returned to our factory by the courier company due to customer’s default or incomplete or erroneous delivery address will not be re-dispatched until the customer pays the shipping costs corresponding to a new shipment (not being able to benefit again of the free shipping costs if your order exceeded the required minimum amounts).
5. PROTECTION OF DATA OF PERSONAL CHARACTER
In compliance with Organic Law 15/1999 of 13 December on the protection of Personal Data, the data provided by our users will become part of an automated file created and maintained by our factory.
Access to the purchase of our products requires registration in a user registry. You can access the personal data deposited in that registry to modify or cancel them (in the registration area there is an option to access the data). The answers to the questions are mandatory. The purpose of collecting these data will not be in any case the assignment of these to other service providers, creation of statistics or other similar purposes, simply this register aims to serve for the best development of our services, ensuring the complete confidentiality of the Data provided and the proper use of the same adopting the necessary technical and organizational measures for the security of this data. The user undertakes that all the data provided are true, and to update them in his case.
6. INTELLECTUAL PROPERTY
All rights of Intellectual Property of the content of this web page, its graphic design and its source codes are property of Basqueland Brewing Project. Corresponding to the exclusive exercise of exploitation rights. Therefore, its reproduction, distribution, public communication and total or partial transformation is prohibited, without the express authorization of Basqueland Brewing Project.
All trademarks, trade names or distinctive signs of any kind that appear on our website are the property of third parties without the user’s use or access to the portal being entitled to any rights on said marks, trade names and distinctive signs.
7. UPDATE AND MODIFICATION
We reserve the right to update, modify or delete the information contained in our website, at any time without prior notice, and without assuming responsibility for it.
8. TECHNICAL ASPECTS
We do not assume liability arising from technical problems or failures in computer equipment not attributable to our company that occur during the connection to the network, as well as damages that could be caused by third parties through illegitimate interferences outside the control of Basqueland Brewing Project.
9. LEGISLATION AND JURISDICTION
These General Conditions will be interpreted according to the current legislation in Spain on the subject, always mediating the good faith.
In case of possible conflicts, the contracting parties will be submitted to the competent courts in the town of Donostia-San Sebastián, Spain.
